GENERAL PROVISIONS
User agrees to use Trout Unlimited Canada (TUC) website in a manner consistent with any and all applicable laws and regulations.

User agrees and warrants that all information submitted to Trout Unlimited Canada will be original, accurate and correct and will not contain any defamatory, fraudulent, abusive, obscene, profane, sexually oriented, threatening, racially offensive or illegal material.

User further agrees and warrants that all information provided to Trout Unlimited Canada will not infringe upon any copyright, trademark, patent or other intellectual property rights of any other person or entity.

User acknowledges that submission or transmission of material or information in violation of any local, provincial or federal law is prohibited and is a breach of these Terms and Conditions of Service.

DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY
Trout Unlimited Canada provides its services on an as-is basis, without warranty of any kind, express or implied, including, without limitation, any warranty for information, services or products provided through TUC. Trout Unlimited Canada specifically disclaims (i) any express or implied warranty of merchantability or fitness for a particular purpose, where applicable, and (ii) any warranties concerning the availability, accuracy or content of information, products or services. This disclaimer of liability applies to any and all damages (including direct, indirect, incidental, special, consequential or exemplary) or injury caused by any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus or other harmful component, communication line failure, theft or destruction or unauthorized access to, alteration of, or use of products and services, whether for breach of contract, tortuous behavior, negligence, or under any other cause of action.

Trout Unlimited Canada cannot promise, and will not be deemed to promise that its hardware or software will function uninterrupted or error-free. TUC fully intends to keep its system functional at all times. However, in the event that, due to circumstances beyond TUC’s control, TUC’s services malfunction or become unavailable to all or some Users, TUC will not be liable for any direct, indirect, special, incidental, consequential or exemplary damages, whether foreseeable or not, which may result from such unavailability or malfunction.

Trout Unlimited Canada is not responsible for the content on the Internet or World Wide Web pages that are contained outside TUC’s site. As a convenience to our Users, TUC may from time to time provide links to third parties that are beyond our control. Trout Unlimited Canada makes no representations as to the quality, suitability, functionality or legality of any sites to which it may provide links, and User hereby waives any claim you may have against TUC with respect to such sites.

II. PRIVACY POLICY
The personal information collected through transactions with Trout Unlimited Canada is collected under the authority of the Alberta Freedom of Information and Protection of Privacy Act, Section 33 (c), and is protected by that Act. The financial information will be used solely to process the payment for the goods or services you have indicated. No financial information will be retained by Trout Unlimited Canada. Any personal information collected by Trout Unlimited Canada is used solely for the purposes stated at time of collection, i.e. to create membership, to accept volunteers, to provide membership services. The membership information may be shared within the organization as part of our chapter and regional activities. This information will not be sold or shared with any third party.
